By accessing or using the services provided by Digital Era Solutions ("Company", "we", "us", or "our"), including our website, AI agents, and related products (collectively, the "Services"), you agree to be bound by these Terms of Service.

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Digital Era Solutions provides AI-powered enterprise automation solutions, including but not limited to: AI Sales Agents, AI Marketing Agents, AI Customer Support Agents, AI Reception Avatars, AI Data Analysts, and Custom AI Agent development.

Our Services are designed for enterprise use and are subject to the specific service level agreements (SLAs) outlined in your subscription or enterprise agreement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or security breach.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to our platform or other users.

You agree to use our Services only for lawful purposes and in compliance with all applicable laws and regulations. You may not use our AI agents to generate harmful, misleading, or illegal content.

You may not attempt to reverse engineer, decompile, or disassemble any of our AI models, algorithms, or proprietary technology. You may not use automated tools to scrape, extract, or copy our Services.

We reserve the right to monitor usage patterns to ensure compliance with these Terms and to optimize service performance.

All AI models, algorithms, software, content, and documentation provided through our Services are the exclusive property of Digital Era Solutions or its licensors, protected by intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to use our Services during the subscription term. Output generated by our AI agents using your data remains your property.

You retain all ownership rights to data you provide to our Services. We process your data solely to deliver the Services and in accordance with our Privacy Policy.

We implement industry-standard security measures to protect your data. However, you acknowledge that no method of electronic transmission or storage is 100% secure.

To the maximum extent permitted by applicable law, Digital Era Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total aggregate liability for any claims arising from or related to the Services shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

Either party may terminate the agreement with 30 days' written notice. We may terminate immediately if you breach these Terms or engage in activity that threatens the security of our Services.

Upon termination, your access to the Services will cease, and we will provide a data export window of 30 days. After this period, your data will be securely deleted in accordance with our data retention policy.

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms shall be resolved through binding arbitration in Riyadh, Saudi Arabia.

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect via email or through a prominent notice on our platform.

Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
